1.All prices quoted are subject to the addition of VAT at applicable rates unless otherwise stated.

  1. We will only carry out the works as detailed in our quotation, additional works will be charged for at current hourly rates plus materials.
  2. Unless otherwise agreed in writing, our quotation is offered on the basis of having a clear working area for our installation works, at the discretion of the company an additional charge may be added if we have to remove debris, etc from installation area.
  3. while we will take all necessary precautousions to locate buried services, either by use of a cable detection device or by acquiring site service location drawings. It shall remain the responsibility of the client to advise upon the position of underground pipes, cables or other services otherwise the company cannot be held responsible for any damage caused thereto, responsibility for the consequences and costs arising from damage or injury from any work carried out on site shall be borne by the client. In the event that we damage or cut through a pipe or cable, we may at our discretion make immediate repairs to prevent spillage or to ensure continued supplies to the clients property, any repairs that we make must be regarded as temporary, and it shall remain the responsibility of the client to ensure that proper long term repairs are made, we do not accept any responsibility whatsoever for the longevity of the temporary repairs that we make.
  4. Unless agreed in writing we will not obtain planning permission prior to commencing work on an installation, on receipt of the clients order it will be assumed that the client has obtained all planning consents necessary for our installation works, we are not liable for obtaining any necessary planning permission required, this is the exclusive liability of the client.
  5. A certificate of public liability insurance is available upon request.
  6. Our quotation is based on the assumption that any spoil shall be disposed of on site, spoil will only be removed from site if agreed in writing prior to commencement of work.
  7. An additional charge will be made to the client if our workmen are kept waiting or are unable to carry out their work as a result of any ‘obstacle’ being our installation area. (obstacles include other workmen, materials, vehicles or excavations)
  8. Where we are installing equipment at ground level, it is the responsibility of the client to ensure that finished ground levels are clearly indicated to us, if we cannot carry out our works or if our equipment is installed too high or too low as result of the wrong level being indicated to us then we will charge the client for any cost incurred in relocating our posts, footings or equipment.
  9. Payment is due to be made by the client to our installers on completion of our installation, at the discretion of the company interest charges may be added to a final invoice where payment is not made on time. The installation is deemed complete once the gate system is turned on for use by the client.
  10. All goods supplied and/or installed remain the property of bank house electric gates until paid for in full, we reserve the right to remove our goods and services in the event of non-payment of our invoices, unless there is legitimate dispute of the invoice. Acceptance of our quotation is acceptance of our terms of business and therefore acceptance by you the client that in the event of non-payment of our invoices we have unconditional access to your property to remove our goods. Without exception.
  11. It shall remain the responsibility of the client for whom the works have been installed, to ensure that our invoices raised are paid in full, payment by the client to a contractor for our works is not payment of our invoice. Where we have worked as a subcontractor for the client’s contractor it shall remain the

responsibility of the client to ensure that their contractors settle our invoices in full, otherwise the client for whom our works have been installed shall be liable to settle our invoices in full, even where they can show that payment has been to their contractors. Payment to a contractor is not payment of our invoice, where a contractor does not settle our invoice/s either through avoidance or bankruptcy the client is liable to settle our invoices in full.

  1. A 10% interest charge will be added to all overdue accounts unless by prior agreement, invoices are due to be paid by return of post or up to 7 days from date of invoice.14. Where necessary the client will arrange for public utilities to be disconnected at their expense prior to work commencing, any resultant delays caused to our contractors will be charged to the client at current hourly or daily rates.
  2. The risk in the goods passes to the customer on delivery, the property in the goods remains Bank House Electric Gates LLP until paid for in full. (See also note 11. Above)
  3. On receipt of your order we will schedule the installation works and issue a proposed start and completion date, in the event that we are unable to commence work on the date stated or to complete the works on the date stated we do not accept responsibility for any costs incurred by the client whatsoever, unless we have agreed in writing that an installation will be completed by a set date as a condition of order.
  4. The position of gates, posts or fittings must be indicated on accurate drawings or marked on the ground by the client prior to commencement of the installation, in the absence of the above we will install the equipment and gates in what we feel to be the most suitable and practical position.18. Gates will be hung with a suitable gap to allow for movement or adjustment of the gates from time to time, the gap between the gate posts and the gate frame will be no less than 5mm and no more than100mm, unless otherwise agreed in writing prior to commencement of the installation and in accordance with current safety regulations.
  5. All cables will be surface run unless otherwise agreed in writing, we will make good any drill holes or chasing in, but we do not undertake to repaint any internal or external surfaces unless previously agreed in writing.
  6. Where our intercom equipment is relayed into your telephone system, we do not guarantee that every possible facility on our intercom system or your phone system will operate, we do guarantee that the system will operate fully as a one-to-one intercom.
  7. An installation will be assumed to be accepted by the client unless any faults or queries with the quality of our installation are reported to our office by telephone or in writing within 7 days of acceptance completion of the installation i.e. gates activated and ready for use by the client, any reported faults made after this time will be dealt with at the discretion of the company.
  8. Start dates for an installation may change without due notice due to emergency servicing requirements or weather. Completion dates for installations are offered only as an indication of the expected time needed to carry out the works needed, we cannot be held responsible if our works are not completed by the date suggested, weather and supplier delays are factors outside of our control, so where a specific completion date is required we will only under take this installation where we have a minimum of 14 weeks lead time in order to take goods in hand to ensure that our works can be completed in the time required,. Bad weather, staff illness and other factors will delay our installations.

and we therefore do not accept any penalties for late completion unless we have specifically agreed in a written contract prior to the installation commencing.

  1. We require a deposit of 30% of the quoted price for the installation to be paid when the order for the installation is placed, a further 40% of the quoted price is to be paid on the day that we start work on the installation, the final *30% of the quoted price will be paid on commissioning of the installation, ( once the gates are activated and in use by the clients ) if payments are not received as detailed herein then work on the installation will cease until the required monies are received. At the discretion of the company. * Final balance not to exceed three thousand pounds, if the final amount is to exceed this figure, then a larger amount should be paid at the interim payment stage to bring the final balance figure down to no more than three thousand pounds.

24.At the discretion of Bank House Electric Gates. Once your written order and deposit payment has been received, we will schedule your installation and order materials and equipment ready to commence your installation, in the event that you cancel your installation for whatsoever reason, You will be liable for the cost of any gates, equipment or materials ordered for your installation, in addition we will charge 10% cancellation fee against you, the client     ( 10% of the value of the installation order ) this charge is made to cover the loss of business and costs incurred to us. In the event that you, the client cancels the installation less than 7 days prior to our proposed installation date, then the cancellation charge shall be increased to 20% to cover our loss of business and costs. (20% of the value of the installation order including VAT)

  1. New installations are covered by our 24 months on-site warranty, this warranty covers all parts supplied and installed by Bank House Electric Gates, the warranty on gate motors will be deemed void if the motor is damaged by external forces ( vehicle impact, forced entry, etc ) warranting a repair to the motor. In this case the damaged/repaired motor will no longer be covered by the on-site warranty, other parts of the installation will not be affected, usual conditions apply. The gate system must be serviced by Bank house gates at least once within the warranty period to maintain the warranty status.
  2. Where wooden gates and posts are supplied and/or installed, we use only the best available timber and gates from quality suppliers, however wooden products can split, twist and warp, also due to the nature of the timbers used in the construction of gates and panels a slight colour variation in the timber must be expected, we accept no responsibility for any natural movement or distortion in any wooden products supplied and/or installed. All wood gates supplied will be pre-treated with a clear preservative, coloured stains/finishes will only be applied if previously agreed in writing. Wood gates should be treated once a year with a suitable treatment to help prevent shrinkage and cracking and where applicable to maintain/refresh the stain or paint finish.
  3. The galvanising and powder coating treatment process used on our steel gates and posts is the best form of treatment for steel, it is a high heat treatment and this can cause slight flex or distortion in gates railings, acceptance of our quotation is acceptance of this possibility that the steel work may not be absolutely straight. Where powder coated gates and railings are installed near the coast, it is advised that the gates/railings are washed at least once a year to prevent salt build up, which can eat into the powder coating and spoil the finish.

28.On occasion Bank House Electric Gates may use specialist sub-contractors to carry out elements of the installation work, these works will be covered by our on-site warranty, and we will ensure that all

works meet our high standards of quality and finishing.

29.The gate installation is deemed complete when the gates are turned on and handed over to the client/end user to use, at this point the balance of payment is due, in the event that any element of the installation is not fully complete then there will be an allowance for the client to retain 10% of the final balance due, until such time as all elements of the system are functioning or complete.

  1. For servicing and maintenance subscriptions, annual price increase may occur. Bank House Electric Gates may increase the price at any point during the contract. Customers will receive 30 days’ notice prior to any increase and can cancel their subscription at any time.
